Alabama - Statute §8-20A-1

- Vehicles Covered:
- All vehicles, new or previously untitled, under 10,000lbs, self-propelled, and intended primarily for operation on public highways. Excludes motor homes.
- Persons Covered:
- Purchasers or any persons entitled to enforce the warranty where vehicle used in substantial part for personal, family, or household purposes.
- Period Covered:
- Whichever is first: one year after date of original delivery or first 12,000 miles.
- Notice Requirement:
- (a) Manufacturer - none, (b) Consumer - written notification describing the vehicle and all previous attempts to correct the nonconformity.
- Repair Requirements:
- It is presumed that a reasonable number of attempts have been made if the same nonconformity has been subjected to three or more repairs, or the vehicle is out of service for a cumulative total of 30 or more calendar days.
- Affirmative Defenses:
- The nonconformity does not significantly impair the use, market value or safety of the vehicle, or is the result of abuse, neglect, or any unauthorized modification or alteration by the consumer; statute of limitations.
- Replacement/Refund:
- At the consumer's option, the manufacturer shall replace with a comparable vehicle, or refund the full purchase price less a reasonable allowance (defined).
- Other Reimbursement:
- Collateral charges, taxes, fees, finance charges and incidental costs.
- Other remedies:
- There is no limit on other consumer remedies: Reasonable attorney fees.
- Arbitration:
- For remedies under this section, a consumer must use the informal dispute procedure established by the manufacturer.
- Resale of Lemon:
- Full disclosure required.
