Introduction to Litigation
Well, you made it this far. You gave the manufacturer a reasonable opportunity to repair. You survived the gauntlet. You learned about your rights and remedies under the lemon law. You are ready to proceed. What do you do next?
In some states you have no choice. You must submit your claim to an informal dispute resolution process. Even in states where arbitration is not mandatory, most manufacturers maintain some sort of informal dispute resolution process, and encourage you to use it before formal litigation.
To Arbitrate or Not to Arbitrate
There are basically three viewpoints from which to look at informal dispute resolution processes: the legal system, the manufacturer, and the consumer.
