Vehicles Covered:

Vehicles, as defined in the Tenn. Code, sold and registered. Excludes motorized bicycles, motor homes, lawn mowers or garden tractors, recreational vehicles, off-road vehicles and vehicles over 10,000lbs.

Persons Covered:

Purchasers, lessees, transferees during the express warranty period or any persons entitled to enforce the warranty. Excludes government or business entity with three or more vehicles.

Period Covered:

Whichever is first: term of express warranty or within one year from date of delivery.

Notice Requirement:

(a) Manufacturer - notify the consumer of repair work done, of the arbitration procedure; (b) Consumer - written notice by certified mail to the manufacturer or his representative; opportunity to cure within 10 days; (c) Business entities that purchase fleets of new motor vehicles and titles. Where the motor vehicle is in the name of a business entity, the seller must disclose in writing the remaining manufacturer's warranty to an individual purchaser.

Repair Requirements:

It is presumed that a reasonable number of attempts have been made if the same nonconformity has been subjected to four or more repairs, or the vehicle is out of service for a cumulative total of 30 or more calendar days.

Affirmative Defenses:

The nonconformity does not substantially impair the vehicle, or is the result of abuse, neglect, or any unauthorized modifications or alterations.

Replacement/Refund:

At the consumer's option, the manufacturer shall replace with a comparable vehicle (defined), or refund the full purchase price less a reasonable allowance (defined).

Other Reimbursement:

Collateral charges Defined: Refunds to consumer and lienholder.

Other remedies:

There is no limit on other consumer remedies: Attorney fees.

Arbitration:

For remedies under this section, a consumer must use the informal dispute procedure established by the manufacturer provided that it complies with 16 C.F.R. 703.
