- Vehicles Covered:
- Passenger cars, pick-up or panel trucks, motorcycles, motorized portions of motor homes and mopeds, demonstrators and lease-purchase vehicles.
- Persons Covered:
- Purchasers, transferees during the express warranty period, or any persons entitled to enforce the warranty where vehicle used in substantial part for personal, family, or household purposes.
- Period Covered:
- 18 months from date of delivery.
- Notice Requirement:
- (a) Manufacturer - provide in warranty or owner's manual clear and conspicuous notification of what the consumer is to do if there is a nonconformity; (b) Consumer - written notification by the consumer or his representative to the address the manufacturer specifies in the warranty or owner's manual.
- Repair Requirements:
- It is presumed that a reasonable number of attempts have been made if the same nonconformity has been subjected to three or more repairs, the nonconformity is a serious safety defect subjected to one or more repairs, or the vehicle is out of service for a cumulative total of 30 or more calendar days.
- Affirmative Defenses:
- The nonconformity does not substantially impair the use, market value or safety of the vehicle, or is the result of abuse, neglect, or any unauthorized modifications or alterations.
- Replacement/Refund:
- At the consumer's option, the manufacturer shall replace with a comparable vehicle acceptable to the consumer, or refund the full purchase price less a reasonable allowance (defined).
- Other Reimbursement:
- Collateral charges and incidental damages.
- Other remedies:
- There is no limit on other consumer remedies: Attorney fees and court costs.
- Arbitration:
- For remedies under this section, a consumer must use the informal dispute procedure established by the manufacturer provided the procedure complies with state and federal laws.
- Dealer Liability:
- None
- Resale of Lemon:
- Full written disclosure required.
