Vehicle Scams, Fraud and Lemon Law Issues

The auto industry and their dealers are rife with scams and fraud and the potential buyer needs to be armed with the knowledge of how these scams work and how to avoid them. While many dealers run reputable businesses and sell buyers a vehicle without any fraudulent means, there are always those individuals or companies that are looking for ways to take consumers for a ride.

One of the issues consumers can run into is a vehicle with a defect that can’t be repaired. The defect is known but the dealer leads the consumer to believe it is his responsibility to repair the fault. Another scam has to do with financing the vehicle. The buyer is often told that they have to have certain insurance products before they can purchase the vehicle, or the dealer tells them they have an ‘on the spot’ approval, but then call them back later as the deal is not “quite done.”

If you are fortunate, you won’t be a victim of one of these disreputable dealers, but it is wise to be aware of potential scams before you head to the dealer. Here are some tips on dealing with auto fraud.
• If you have bad credit and are unsure if you will get financed for the car, take extra care. Come prepared; get financing in advance.
• Make sure you read all documents presented to you, especially those that require signatures. Oral statements made by the dealer’s representative are of very little value in the event a dispute arises. Don’t count on their interpretation of any agreements or documents.
• Demand a copy of each document presented to you at the time of the sale.

In California there are two laws that cover the majority of cases involving the lemon law and fraud.
• “Lemon Law” The Song Beverly Consumer Warranty Act
• “Fraud” Consumer Legal Remedies Act

The Lemon Law protects us from defective vehicles that cannot be fixed after numerous repair attempts. The Consumer Legal Remedies Act (CLRA) provides California consumers with strong legal rights against unfair and deceptive business practices. It provides them with efficient and economical procedures to secure those rights.
